Voice Your Opposition to Senate Bill 329 (February 22, 2010)
Senate Bill 329, introduced by Senator Richard H. Stuart of Virginia District 28 proposes to increase the filing fee on all civil actions in General District court from the current minimum of $27 to $75. CAI’S Virginia Legislative Action Committee needs your help to contact members of the House of Delegates which will consider the Bill.
Senate Bill 329 creates an unnecessary burden on community associations and their members, many of whom are struggling in these difficult economic times. If Senate Bill 329 passes, an additional $48 would be added to any new civil case filings paid for by community associations filing suit and ultimately added to judgments against delinquent owners already facing economic difficulties. In these economic times, adding increased charges is not good policy and will adversely affect community associations and delinquent owners alike.
Although the intention of Senate Bill 329 appears to be increased funding of our court system, much of the money raised by Senate Bill 329 is diverted instead to local sheriff’s office.
Please voice your opposition to this Bill. Senate Bill 329 passed the Senate by a narrow margin of 6 votes (23-Y, 17-N). We expect another close vote in the House of Delegates.
The bill will be considered by the House Courts of Justice Committee. Contact information for each member of the Committee is set out below. Senate Bill 329 is likely to be referred to committee. Voice Your Support for House Bill 1100
CAI seeks your continued support of House Bill 1100. Introduced by Delegate Mark D. Sickles of Fairfax, the bill creates qualified immunity for community associations for injuries sustained in storm water facilities located on community association common area.
CAI support was instrumental in the effort for House Bill 1100’s passage by the House of Delegates (69-Y, 29-N) but additional work needs to be done to see the bill passed in the Senate. Since passing the House of Delegates, Governor Bob McDonnell has indicated his support for the Bill.
