Dear Senator:
On behalf of _________________ Association, a community of _____ homes, in _________________, Virginia, this e-mail is intended to express our full support of House Bill 1100. HB1100 would grant homeowners qualified liability for incidents occurring around stormwater facilities for which management and maintenance duties have been taken over by a locality. HB1100 allows homeowners' associations and localities to enter into an agreement for this specific purpose, while the HOAs would remain responsible for gross negligence and willful misconduct. This bill serves to clarify responsibilities related to stormwater facilities, ensuring that community associations are able to maintain adequate liability insurance coverage.
The qualified immunity afforded to homeowners' associations by HB1100, combined with our own efforts to care for these areas, would provide the community a level of protection which is currently lacking. The bill passed the House Agriculture, Chesapeake, and Natural Resources Committee, as well as the full House, with overwhelming bipartisan support. We hope you will vote for HB1100 in the Senate Committee on Agriculture, Conservation, and Natural Resources, and not re-refer it to another committee, so it may pass during the 2010 legislative session.
